Terms of use and privacy policy

Terms of use

These Terms of Use apply to all users of Te Hono websites, including its social media channels (each a Site and, together, the Sites).

 

The Sites are operated or administered by the Te Hono, which is an alumni group of NZ primary sector leaders (We/Us). By viewing or using a Site you agree to these Terms of Use and the Privacy Statement without qualification.

If you do not agree to be bound by these Terms of Use and the Privacy Statement, then you must stop accessing and using the Sites.

1. Copyright and limited reproduction notices: Unless we specify otherwise in writing, nothing in these Terms of Use or your use of a Site will confer on you any ownership or other rights in our intellectual property owned or licensed. Unless we have expressly authorised on the Sites, no part of the Sites may be distributed or copied for any commercial purpose and you are not permitted to incorporate the material on any Site or any part of it in any other work or publication (whether in hard copy, electronic or any other form). Subject to clause 2, no part of the Sites may be reproduced, transmitted or stored (including in any other website or other electronic form).

2. You may print, download to your hard drive or cloud storage device, or share on social media extracts from the Sites only for your own personal or internal business use, but only if you: (a) retain all relevant copyright and other proprietary notices on each copy; and (b) use the material in a manner consistent with these Terms of Use.

3. Linking: The contents of the Sites may include links to third party websites or materials (Linked Sites). We will not be responsible for the contents of any Linked Site and will not be liable for any direct or indirect loss or damage suffered by you from accessing, using, relying on or trading with third parties. The inclusion of any link does not imply our endorsement of the Linked Sites or any association with their operators.

4. Linking by User: You may include links from your site to a Site. However, we reserve the right to prohibit your linking to a Site at any time, and you must remove or cease any link at our request. You must not frame any part of the material on a Site by including advertising or other revenue generating material and you must not modify, edit or otherwise interfere with any Site or any material on any Site. If you do create a link to any page on the Sites, you are responsible for the consequences of that link and you will keep us indemnified and held harmless against all costs, expenses and damages it may suffer or incur arising from, or in connection with, that link.

5. Posting information or blogs on a Site: You may post information or statements on parts of the Sites, as indicated, for example, through a feed or on a forum. However, you must not post: (a) any information, statement or material which is defamatory, obscene, threatening, untrue or in breach of any applicable laws rules or regulations or these Terms of Use; (b) any information, statement or material which is in breach of any person's rights, including copyright and confidentiality; (c) any information or material that will introduce a virus or computer programming code which would have the effect of disrupting, impairing, disabling or otherwise adversely affecting use of a Site. We do not monitor, approve, endorse or exert editorial control over information posted by users on the Sites and does not accept responsibility for, or make any warranties in connection with, that information. We reserve the right to remove any information or statement from the Sites without warning. By placing information or statements on a Site, you grant us a non-exclusive, perpetual licence to use, copy, distribute, publish and transmit such information in any form, unless otherwise agreed in writing by us and you.

6. Advertisers: Any dealings with any advertiser appearing on the Sites are solely between you and the advertiser. We are not responsible or liable for any part of any such dealings or promotions or for any loss or damage you may suffer or incur as a result.

7. Membership: Membership to Te Hono is by invitation. Where this option is offered, you must complete the registration process by providing us with current, complete and accurate information as prompted by the registration form. We reserve the right to reject any application for registration or revoke any registration for any reason whatsoever. If you are a registered user on a Site, you may only log-in using the username given to you during the registration process and your password. You must not use anyone else's username and password or share your username and password with anyone else. You are responsible for all use of the Sites made using your username and password.

8. Disclaimer: Although we have taken reasonable care to ensure the facts stated in the Sites are accurate and the opinions given are fair and reasonable, we do not give you or any other person any warranty of accuracy, reliability or fitness for any purpose in relation to the information and materials contained on a Site, or that the Sites are complete, accurate, up to date or available at any time. You acknowledge and agree that we do not offer any opinion or recommendation with respect to the nature, potential value or suitability of any particular transaction or strategy. Use of information contained on the Sites is at your own risk and we are not responsible for any adverse consequences arising out of such use. We reserve the right to change the information on the Sites at any time without notice. If you enter into any transaction subsequent to accessing any of the Sites, you do so entirely in reliance on your own judgement and inquiries and (unless we specify otherwise in writing) not in reliance on any statements, warranties or representations made to you or to any other person by or on behalf of us. Accordingly, all express or implied warranties and representations are excluded to the maximum extent permitted by law. 

9. Limitation of liability and indemnity: To the fullest extent permitted by law, we exclude all responsibility and liability in relation to the Sites and your use of the Sites and we will not be responsible for errors or misstatements or be liable to you or any other person, whether in contract, tort (including negligence) or otherwise, for any loss or damage however caused (including direct, indirect, consequential, special, economic loss, loss of profits, revenue or goodwill). You will indemnify us, our Steering Committee and employees and hold each of them harmless against all costs, expenses and damages incurred in connection with any claim brought by a third party against us arising from a breach by you of any of these Terms of Use or the Privacy Statement.

10. Amendments: We reserve the right to change or update these Terms of Use and the Privacy Statement at any time by posting updated or changed versions of the Terms of Use and the Privacy Statement on its Sites. By continuing to access the Site, you agree to be bound by the changed or updated Terms of Use or Privacy Statement.

11. Governing Law: These Terms of Use are governed by, and will be construed in accordance with, the laws of New Zealand and you submit to the non-exclusive jurisdiction of the courts of New Zealand without regard to conflicts of law principles. We also retain the right to bring proceedings in any other court of competent jurisdiction of our choice.  To the fullest extent permitted by law, we are not responsible for the compliance of the Sites, or the material contained in them, with the laws of any other country.  If you access the Sites from outside New Zealand, you are responsible for complying with all applicable laws.

12. Professional advice: We suggest that you consider seeking relevant independent professional advice before proceeding with a transaction.

Privacy statement

We collect personal information from you, our alumni, including information about your:

·        name

·        information

·        location

·        computer or network

·        interactions with us

·        billing or purchase information.

We collect your personal information in order to maintain up to date profiles, for registration for events and showcasing projects including case studies, profiles, etc.

Besides our staff, we share this information with the NZ primary sector leaders who are alumni of Te Hono in order to connect via email with each other.

Providing some information is optional. If you choose not to enter your photo, profile or information, we'll be unable to profile you or connect you with the other alumni members.

You have the right to ask for a copy of any personal information we hold about you, and to ask for it to be corrected if you think it is wrong.
